Car accident victim dies on North Carolina Highway 109

Three cars were involved in an accident on North Carolina Highway 109 recently. One car accident victim did not survive and was pronounced dead at the scene. One other person had to be taken to an area hospital by helicopter and is still listed as being in critical condition.

The accident occurred when a vehicle traveling south on North Carolina Highway 109 drifted into oncoming traffic and slammed head-on into another vehicle. After those vehicles came to a rest, a third vehicle heading south on the highway struck the other southbound vehicle before emergency personnel could arrive at the scene. The driver and passenger of that vehicle suffered injuries that were treatable at the scene.

The driver of the third vehicle has been charged with driving while impaired, and more charges may yet be filed. Police have also said that the driver of the southbound vehicle will face charges in connection with this accident. The investigation into both accidents is ongoing.

The family of the car accident victim that died may have a clear reason to file a wrongful death claim against the first southbound vehicle, but not the second. It is still unknown whether the second southbound vehicle impacted the northbound vehicle at all. It may be some time before the family of the deceased driver knows exactly what happened that day. If the family can prove to a court that the party or parties deemed responsible for their loved one’s death was negligent, the court may award the family the costs and damages incurred as a result of the accident and the driver’s untimely demise.
