Vacuum extraction and forceps are not necessarily bad. When they work, they can be invaluable for a child’s life and health. However, in rare cases, serious injury or wrongful death results from a doctor’s:

  • Unnecessary or improper use of forceps or vacuum extraction: Forceps and vacuum extraction technology have saved the lives of countless children. They are great tools, but they are also very dangerous; they should be used with extreme care, and only when it is absolutely necessary.
  • Failure to use forceps or vacuum extraction when necessary: Someone should always be watching for signs of fetal distress, especially when a child is not moving through the birth canal normally. Lack of adequate monitoring is a common nursing error. This leads to a slow reaction by the obstetrician, resulting in cerebral palsy, Erb’s palsy, wrongful death, or other terrible consequences.
  • Defective forceps or vacuum extraction tools: In some cases, the accident is caused not by the doctors or nurses, but by the equipment itself. If faulty forceps or vacuum extraction equipment caused your child’s accident, we can bring a product liability lawsuit for defective design or defective manufacture of the tools.
