The man was mentally unstable. During the conversation, Mims lunged at the police officer with a box cutter he had initially held against his own throat. The police shot and killed Mims on the spot.

The criminal case against the police officer was found not guilty. The district attorney ruled that the shooting was justified. However, the Mims family is not taking this plea. Instead, they are suing for wrongful death. This kind of civil suit can be filed alongside or after a criminal trial. If the criminal charge does not end in your favor, it does not mean that the wrongful death suit will not go in your favor.
